Alzheimer’s Association Positions

September 2008

SB 491 Alquist   State Alzheimer's Disease Strategic Plan  Requires the Alzheimer's Disease and Related Disorders Advisory Committee to develop the State Alzheimer's Disease Strategic Plan. Requires the committee to collaborate with a broad group of stakeholders, and to review current state policies and practices concerning treatment for Alzheimer's disease, and to develop specified recommendations relating to Alzheimer's care in the state.  Requires the Secretary of Health and Human Services to appoint two people who have been diagnosed with Alzheimer’s or another dementia to a one–year term on the Alzheimer’s Advisory Committee. Status: Signed by Governor

AB 749 Wolk Requires a residential care facility for the elderly to have an emergency plan that includes evacuation procedures, provisions for alternative power, and procedures for care and assessment during an emergency. Status: Signed by Governor

AB 759 Karnette Requires every residential care facility for the elderly that is licensed as of January 2010 to care for not more than 6 residents to have an approved, operable automatic fire sprinkler system by January 2011. Any facility licensed after January 1, 2010, will be required to have sprinklers.  Requires the State Fire Marshal to adopt regulations to implement these provisions by January 1, 2009, including addressing those fire safety features no longer required of a licensee after an operable automatic fire sprinkler system has been installed and maintained. Status: Vetoed by Governor

AB 2105 DeSaulnier Expands the category of mandated reporters of suspected financial abuse to include both licensees as that term is defined under the State Finance Lenders Law, the State Residential Mortgage Lending Act, and real estate brokers, as defined in specified provisions of the Real Estate Law. Status: Vetoed by Governor

AB 2370 Bass Requires the licensee of a residential care facility to disclose to current facility residents its average monthly rate increases over the previous 3 years. Requires the licensee to post such disclosure, and to provide a written copy to new and prospective facility residents. Status: Signed by Governor

AB 2375 Hernandez Requires the Office of Statewide Health Planning and Development to establish the Health Professions Workforce Task Force to assist in the development of a health professions workforce master plan for the state. Requires the task force to submit recommendations for a health professions workforce master plan. Requires the Legislative Analyst's Office to compile a baseline report to assess the state's health professional workforce data collection capacity and to report their findings to the task force. Status: Held in Senate Rules Committee

AB 2543 Berg Establishes the Geriatric and Gerontology Workforce Expansion Act. Provides loan repayment assistance to physicians and surgeons, nurses, clinical social workers, and marriage and family therapists who work in a geriatric care setting. Raises the licensing and renewal fees of these licenses. Establishes the Geriatric and Gerontology Student Loan Assistance Program and requires the Office of Statewide Health Planning and Development to report annually to the legislature with regard to the program. Status: Vetoed by Governor

AB 2716 Ma Requires employers to provide paid sick time, upon request of employee, for diagnosis, care, or treatment of health conditions of the employee or an employees family member, or for leave related to domestic violence or sexual assault. Provides that an employer would be prohibited from discriminating or retaliating against an employee who requests paid sick time. Exempts construction employees covered by a collective bargaining agreement if the agreement expressly waives the requirements of these provisions. Status: Held in Senate Appropriations Committee

AB 2947 Eng Amends existing law that provides that a written agreement to submit to arbitration a controversy thereafter is valid. Provides that these provisions shall not apply to any arbitration agreement applicable to a controversy between a residential care facility for the elderly and an elder or a dependent adult if specified violations occur. Prohibits a facility from requiring that an elder waive rights to file complaints or pursue a civil action based on a claim for physical abuse, neglect or death. Status:  Vetoed by Governor

SB 434 Romero Would amend the language in the Budget Trailer bill that creates a stakeholder group to make recommendations on changes in the nursing home rate reform law.  SB 434 would provide that the group include ten consumers, five providers and five workers.  The budget bill provides the membership shall be equal among the three.  Also calls for the Department of Health Care services to develop a plan to verify staffing and to consider requiring quarterly payroll reports. Status: Senate Rules Committee

SB 535 Kuehl Amends existing law which requires the State Department of Health Care Services to develop and establish a consumer information service system to provide information to the general public and consumers regarding long-term health care facilities in their communities. Revises information to be provided and how that information is made available to the general public and consumers. Status: Vetoed by Governor

SB 1140 Steinberg  Adds to the definition of financial abuse, the taking, secreting, appropriating, obtaining, or retaining, or assisting in the taking, secreting, appropriating, obtaining, or retaining, of real or personal property of an elder or dependent adult when the elder or dependent adult lacks capacity, or by undue influence, or both.
